Privacy policy
This site is run by Miller Hawkins, a photographer based in South Florida (“I,” “me,” “my”). This policy explains what information I collect through millerhawkins.com (the “Site”), how I use it, and the choices you have.
Information you give me
When you send an inquiry, I receive what you enter in the form: your name, email address, phone number (optional), the type of shoot, a date, a location and your message. Please don’t include sensitive information such as financial account numbers, government ID numbers or health information in the form.
Information collected automatically
- Analytics. The Site uses Google Analytics to understand how visitors use it: pages viewed, time on page, the site that referred you, your device and browser type, and your approximate location (city or region) derived from your IP address. Google Analytics uses cookies and similar identifiers to do this.
- Hosting logs. The Site is hosted by Netlify, which automatically records basic technical information such as IP address, browser type and the pages requested, for security and to keep the Site running.
Cookies and your choices
Google Analytics sets cookies (such as _ga) in your browser. A banner lets you accept or decline them, and you can change your choice at any time with the Cookie settings link at the bottom of every page.
- In the European Economic Area, the United Kingdom and Switzerland, Google Analytics is not loaded until you click Accept.
- Everywhere else, Google Analytics runs unless you click Decline.
- If you click Decline, Google Analytics stops right away and is not loaded again.
- If your browser sends a Global Privacy Control signal, the Site does not load Google Analytics at all, and you won’t see the banner.
When you click Decline, the Site stops sending anything to Google Analytics, deletes its analytics cookies, and doesn’t load Google Analytics on later visits. You can also block or delete cookies in your browser settings, or install Google’s Google Analytics opt-out browser add-on. The Site works the same whether or not you allow analytics. Your banner choice is saved in your browser’s local storage so you aren’t asked again.
How I use information
- To reply to your inquiry, prepare a quote, and schedule, plan and deliver a shoot.
- To understand which parts of the Site people use, and to improve it.
- To keep the Site secure and to prevent spam and abuse.
- To comply with the law and to protect my rights and the rights of others.
How information is shared
I do not sell your personal information, and I do not share it for targeted advertising. I share it only:
- With service providers that help run the Site and my business, such as Netlify (hosting and form handling), Google (analytics) and my email provider, which may process it only to provide their services;
- When required by law, subpoena or other legal process, or when I believe in good faith that disclosure is needed to protect my rights, your safety or the safety of others;
- As part of a transfer of my business, in which case this policy would continue to apply to your information.
How long I keep it
I keep inquiry information for as long as needed to respond to you and, if we work together, for as long as needed for that project and my business, tax and legal records. Analytics data is kept according to the retention settings in Google Analytics.
Security
The Site is served over an encrypted (HTTPS) connection, and I use reasonable measures to protect the information I receive. No method of transmitting or storing data is completely secure, so I can’t guarantee absolute security.
Your rights
You can ask me to tell you what personal information I hold about you, correct it, or delete it. Depending on where you live (for example California, Colorado, Connecticut, Virginia and other U.S. states with privacy laws, or the European Union and United Kingdom), you may have additional rights under local law, such as the right to opt out of certain processing or to appeal a decision about your request. I will not treat you differently for exercising your rights. Where EU or UK law applies, I rely on your consent and on my legitimate interest in responding to inquiries and running the Site, and you may complain to your local data protection authority. To make a request, use the contact form. I may need to verify your identity before acting on it.
Children
The Site is not directed to children under 16, and I do not knowingly collect personal information from them. If you believe a child has sent me personal information, contact me and I will delete it.
Other sites
The Site links to other sites, such as Instagram and LinkedIn. Their own privacy policies apply, and I’m not responsible for their practices.
Changes
I may update this policy from time to time. The version posted here is the one in effect.
Terms of use
By using the Site you agree to these terms. If you don’t agree, please don’t use the Site.
Inquiries and bookings
Sending an inquiry does not create a contract, reserve a date or guarantee availability. A shoot is booked only when we both sign a written agreement and any required retainer is received. That agreement, not these terms or anything on the Site, governs the work, pricing, deliverables, usage rights and cancellation. Descriptions of services on the Site are general and may change.
Acceptable use
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, sending spam or malicious code through the form, or using automated tools to scrape or copy it.
No warranties
The Site and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. I don’t promise that the Site will be uninterrupted, error-free or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Miller Hawkins will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to your use of the Site. My total liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars ($100). This section does not limit any liability that cannot be limited under applicable law, and it does not apply to a signed client agreement, which governs on its own terms.
Indemnity
You agree to indemnify and hold me harmless from any claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these terms or of anyone else’s rights, including copying or using my photographs without permission.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or related to the Site will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
General
If any part of these terms is found unenforceable, the rest stays in effect. My failure to enforce any part is not a waiver. I may update these terms at any time; continued use of the Site means you accept the current version.
Copyright & image use
All rights reserved
Every photograph, video and piece of text on the Site is © Miller Hawkins, all rights reserved, and is protected by U.S. and international copyright law. Viewing the Site does not give you any license or right to use them.
What you may not do
Without my prior written permission, you may not:
- Download, copy, screenshot, reproduce, publish, distribute or display any image, including on social media, websites, in print or in advertising;
- Edit, crop, filter or alter any image, or remove or change any copyright notice, watermark or metadata;
- Hotlink to, frame or embed images from the Site;
- Use any image, or the Site’s content, to train, fine-tune or test artificial intelligence or machine-learning systems, or include it in any dataset;
- Use any image to suggest that I, or anyone shown, endorses a product, service, cause or person.
Sharing a link to a page on the Site is fine. To license an image for editorial, commercial or personal use, send a request through the contact form. Unauthorized use may result in a demand for licensing fees and legal action, including claims for statutory damages where available.
People in these photographs
The public figures shown on the Site appear as examples of my editorial, news and event photography. Their appearance does not mean they endorse, sponsor or are affiliated with me or my services, and none of these images may be used to imply that. Private clients appear with their permission. If you appear in an image and would like it removed, contact me and I will review your request promptly.
Trademarks and publications
Names and logos of publications, networks and other organizations shown on the Site are the trademarks of their respective owners. They appear only to identify outlets where my work has been published or broadcast and do not imply that those organizations endorse or are affiliated with me.
Report misuse
If you see one of my photographs used somewhere without credit or permission, please let me know through the contact form.
